1. Acceptance of Terms

By accessing or using our booking platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree, please discontinue use of the platform. By accepting these Terms, you also accept and agree to the Data Processing Agreement, which forms an integral part of these Terms.

2. Description of the Service

Our platform provides tools for managing bookings, appointments, payments, customer communication, and business operations. We may update, modify, or improve the Service at any time to ensure proper functionality and user experience.

3. Account Registration and Eligibility

  • You must provide accurate and complete information when creating an account.

  • You are responsible for maintaining the confidentiality of your login credentials.

  • All actions performed through your account are your responsibility.

  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

  • attempt unauthorized access to any part of the platform;

  • use the Service for illegal, fraudulent, or abusive activities;

  • copy, modify, distribute, or reverse-engineer any part of the platform;

  • use automated tools (bots, scrapers) without permission.

5. Bookings, Payments, and Subscriptions

  • Subscription plans renew automatically unless canceled.

  • Failure to pay may result in suspension of access.

  • Pricing, fees, and charges may be updated with prior notice.

  • You are solely responsible for your own booking policies, cancellations, refunds, and customer communication.

6. Intellectual Property

All rights to the platform, including software, design, and content, belong to us. You are granted a limited, non-exclusive, revocable license to use the Service.

7. User Data and Your Customers' Data

You retain ownership of all data you upload (bookings, customer information, business details). You grant us permission to process this data solely for:

  • providing the Service;

  • backups and recovery;

  • aggregated and anonymized analytics to improve the platform.

8. Data Protection — Your Responsibilities as Controller

You (the "Tenant") are the data controller for any personal data relating to your customers, employees, and end users (together, "Customer Data") that you input into or collect through the Service. We act as a data processor in respect of Customer Data, as set out in the Data Processing Agreement.

You are solely responsible for:

  • obtaining any lawful consent and providing the privacy notices required to collect and process Customer Data, and informing your customers about the processing;

  • having a valid legal basis for the processing of Customer Data, including any special categories of data (such as health or medical data) under applicable data protection laws;

  • complying with all applicable laws and regulations, including the GDPR and any sector-specific rules (such as HIPAA for US healthcare customers), and for deciding how you use the Service;

  • providing your customers with their own privacy policy and any information they are entitled to receive.

To the fullest extent permitted by law, and except to the extent caused by our own gross negligence or willful misconduct, we are not liable for any claims, damages, or losses arising from your use of Customer Data or from your failure to comply with applicable law, including without limitation your failure to obtain required consents or to provide required notices.

9. Health and Medical Data (HIPAA)

The Service may be used by customers in the health and wellness sector. We are not a "Covered Entity" or "Business Associate" as defined under the US Health Insurance Portability and Accountability Act (HIPAA), and we do not provide a Business Associate Agreement (BAA) unless a separate BAA is expressly agreed in writing. You are responsible for your own compliance with HIPAA and any other applicable health-data laws, and for entering into any BAA required for your own operations.

We do not access, export, or otherwise use your customers' data for our own purposes, and we process such data only to provide and maintain the Service on your behalf.

10. Availability and Limitations

While we aim for high availability, we do not guarantee uninterrupted service. The platform is provided "AS IS" without warranties of any kind, to the maximum extent permitted by applicable law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, gross negligence, or willful misconduct.

11. Limitation of Liability

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to these Terms or the Service is limited to the amount you have paid to us for the Service in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, incidental, special, or punitive damages, or for lost profits, loss of data, or loss of goodwill.

12. Termination

You may close your account at any time. We may suspend or terminate access for violations, non-payment, or misuse. Upon termination, you may export your data in accordance with the Data Processing Agreement, and we will delete your data in accordance with its terms, except where retention is required by law.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and, where material, notify you by email. Continued use of the Service after the updated Terms are posted constitutes acceptance of the changes. If you do not agree, you may close your account before the changes take effect.

14. Governing Law

These Terms are governed by the laws of [our jurisdiction]. Any disputes arising out of or relating to these Terms or the Service will be resolved in the competent courts of [our jurisdiction].

15. General

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect (severability). These Terms, together with the Data Processing Agreement and Cookie Policy, constitute the entire agreement between you and us regarding the Service.
